Welcome to GunSwap (“Platform”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Service”). By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not access or use the Service.

You must be at least 18 years of age and legally permitted under applicable local, provincial, and national laws to access and use the Service. By using the Service you represent and warrant that you meet all eligibility requirements.

GunSwap operates in jurisdictions where the licensed trade of firearms and related goods is lawful. You are solely responsible for ensuring your use of the Service complies with all applicable laws, including firearms licensing regulations in your jurisdiction.

To access certain features of the Service, you must register for an account. When registering you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your information to keep it accurate and complete.
• Keep your password confidential and not share account credentials with any third party.
• Accept responsibility for all activity that occurs under your account, whether or not authorised by you.
• Notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate your account at our sole discretion, including where we believe that you have violated these Terms.

The Service may permit you to post, upload, or otherwise submit content including listings, descriptions, images, reviews, and comments (“User Content”). You retain ownership of any intellectual property rights you hold in that content.

By submitting User Content you grant GunSwap a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, host, store, reproduce, modify, create derivative works from, communicate, publish, publicly perform, and distribute such content for the purposes of operating, promoting, and improving the Service.

You represent and warrant that: (a) you own the User Content or have the necessary rights to grant the above licence; and (b) the User Content does not infringe the rights of any third party and complies with these Terms and all applicable laws.

You agree not to use the Service to:

• Post or facilitate any unlicensed or illegal sale or transfer of firearms.
• Violate any applicable law or regulation, including firearms licensing and transfer laws.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other harmful or disruptive code or content.
• Scrape, crawl, or harvest data from the Service without our prior written consent.
• Circumvent, disable, or interfere with security features of the Service or features that prevent or restrict use or copying of any Content.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm GunSwap or its users.
• Post false, misleading, or fraudulent listings or information.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of GunSwap and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GunSwap.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended personal, non-commercial purposes.

The Service may contain links to third-party websites or services that are not owned or controlled by GunSwap. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We strongly advise you to read the terms and privacy policy of any third-party site you visit.

The inclusion of any link does not imply GunSwap's endorsement of the site.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUNSWAP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

You agree to defend, indemnify, and hold harmless GunSwap and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law.

We may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with applicable law. Any dispute arising in connection with these Terms shall be resolved in the courts of competent jurisdiction. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will endeavour to provide at least 14 days' notice prior to any new terms taking effect.

Your continued access to or use of the Service after revisions become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
